This action was heard after entry of defaults against all defendants who have not consented of record to partition of the subject property and

IT IS ADJUDGED that:

1. The subject property, as described in the Complaint, is heir property owned by the Larry Barginear Estate having a 2/3 undivided interest and the Jodie Moore Estate having a 1/3 undivided interest.

2. Due to the large number of heirs and the physical characteristics of the subject property, which include irregular shape and wetlands and utility easements crossing the property, equitable physical partition of the subject property is not feasible. Accepting the uncontested allegations of the Complaint as true, the Court finds that an open sale by private listing with a local broker is the appropriate means of securing fair value and equitable distribution of the property’s value among the heirs.

3. Plaintiff,  Annette Barginear, as the personal representative of the Larry Barginear Estate (“Barginear”), through counsel, provided appraisals from a recent eminent domain proceeding in this Court and an updated market value opinion from a local real estate broker, Dan Gullahorn, all indicating that a current market value for the subject property is within a range from $155,000 to $195,000 or approximately $2,775 to $3,600 per acre, which the Court finds is reasonable. Based on his years of experience  in real estate sales in Escambia County, the Court considers Mr. Gullahorn to be qualified to offer opinions regarding the current market conditions and value of the subject property and to recommend an appropriate listing price to offer the property for sale. Accordingly, the Court accepts Mr. Gullahorn’s  recommendation that the subject property should be listed for sale at a price of $170,000 and may need to be sold in parts due to the separation of segments of the property by roadways and natural features.

4. The Court hereby grants Barginear's request for leave to list the subject property for sale with Mr. Gullahorn's firm for a sales price of $170,000 for the entirety of the acreage owned by the Barginear and Moore Estates, and further authorizes, without need for separate orders, sale of the entirety of the property within the value ranges indicated above or sale of individual portions of the property for per acre prices within the range, if deemed by Barginear to be practical to achieve a higher purchase price overall based on recommendations by Mr. Gullahorn. Any listing agreement with Mr. Gullahorn shall be on commercially reasonable terms and shall provide for no greater commission than 10%, which shall include and cover any commission split negotiated with a purchaser's agent.

5.  Mr. Gullahorn may reduce the sale price to encourage sale by no more than 1 % per month and Barginear is authorized by this judgment to contract for sale for the then current listing price or less than the then current listing price so long as the price is within the value ranges indicated above without further order of the Court, and to renew the listing agreement if it expires before the property sells. Should an offer to purchase be received for less than the range approved herein and, in the judgment of Barginear, the offer should be accepted, Barginear must make any contract for sale at such lower price conditional upon receiving Court approval for the sale. Upon notice to the Court of a sale of the property or a portion thereof for a sales price within the ranges of value approved above, the Court may issue an order confirming the sale if requested by the purchaser, but this judgment shall constitute Court authorization for transfer of title for any sale made in accordance with the terms hereof, subject to the interests of any easements or restrictions of record.

6. A copy of this partition judgment shall be provided to all defendant heirs with known addresses and shall be served on the other defendants by publication. Any heir wishing to object to the valuation established herein may do so within 30 days after service of this judgment by filing their objection with the Court which must state with particularity the grounds for any such objection and shall serve a copy of same on Barginear's counsel.

7. Any defendant heir desiring to make an offer to purchase the subject property as a 
cotenant under Section 64.207, Florida Statutes, shall give notice of such intention to the Court within 45 days after service of this judgment in accordance with Section 64.207(2), Florida Statutes, and shall serve a copy of same on Barginear' s counsel.

8. The proceeds of any sale authorized hereunder shall be deposited in the registry of  the Court and held by the Clerk pending order or orders directing disbursements.

9. The Court reserves jurisdiction to conduct further hearings as may be necessary for  determination of the respective interests of the heirs, including any equitable adjustments of the respective shares and to enter orders for distribution of the proceeds after notice to the parties and hearing, and to authorize payment of reasonable fees and costs of these proceedings from such proceeds pursuant to Section 64.081, Florida Statutes.
