These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Florida Housing Finance Corporation.

 

REQUEST FOR RELEASE OF FUNDS
On or about February 24, 2025 the Florida Housing Finance Corporation (FHFC) will submit a request to the State of Florida Department of Florida Commerce (Florida-Commerce) Office of Long-Term Resiliency for the release of Community Development Block Grant – Disaster Recovery (CDBG-DR) funds under Title I of the Housing and Community Development (HCD) Act of 1974, as amended to be used jointly with Tax-Exempt Bonds and Non-Competitive Housing Credits in Counties Deemed Hurricane Sally Recovery Priorities to undertake a project known as Avery Place located at the Southwest corner of North H Street and West Avery Street, Pensacola, Escambia County, FL 32501. The proposed development is for the construction of one mid-rise (4-story) residential building consisting of 112 units: 18 one-bedroom/one-bathroom units, 36 two-bedroom/two-bathroom units, 38 three-bedroom/two-bathroom units, and 20 four-bedroom/two-bathroom units. Additionally, the project development will include 125 parking spaces and a stormwater retention area. Construction costs are estimated at $36,520,078, which is to be partially funded with CDBG-DR in an amount up to $7,000,000, Local HFA Bonds in an amount up to $24,000,000 and annual Non-Competitive Housing Credits in an amount up to $1,736,971. As stipulated by HUD, an Environmental Review is required of the subject property according to 24 CFR Part 58.

 

FINDING OF NO SIGNIFICANT
IMPACT
The Florida Housing Finance Corporation has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Florida Housing Finance Corporation, 227 North Bronough Street, Suite 5000, Tallahassee, FL 32301-1329, and may be examined or copied weekdays 9:00 AM to 4:00 PM.

The Florida Housing Finance Corporation certifies to the Florida-Commerce that Ms. Angeliki Sellers, in her capacity as Chief Financial Officer of the FHFC, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Florida-Commerce’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows FHFC to use Program funds.

 

OBJECTIONS TO RELEASE OF FUNDS
Florida-Commerce will accept objections to its release of funds and the Florida Housing Finance Corporation’s certification for a period of fifteen (15) days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases:  (a) the certification was not executed by the Certifying Officer of the Florida Housing Finance Corporation; (b) the Florida Housing Finance Corporation has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the development process have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by Florida-Commerce; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted via email in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Florida-Commerce Office of Long-Term Resiliency, CDBG-DR Program, 107 East Madison Street, Tallahassee, FL 32399. Construction costs are estimated at $29,824,427 which is to be partially funded with CDBG-DR in an amount up to $7,000,000, Local HFA Bonds in an amount up to $18,000,000 and annual Non-Competitive Housing Credits in an amount up to $1,416,781. As stipulated by HUD, an Environmental Review is required of the subject property according to 24 CFR Part 58.
