FOR REMEDIATION

 

The Department of Environmental Protection gives notice of agency action of entering into the Third Modification to Remedial Action Plan Approval Order
(RAP Order) with Randall K. Chavers, Mary Ann Runyon, and Chavers Construction Inc. The RAP Order
 
addresses remedial action for soil and/or water contamination located at 2484 Eastman Lane in Cantonment, Escambia County, Florida. The RAP Order is available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the Department of Environmental Protection, Northwest District, 160 W. Government Street Suite 308, Pensacola, FL 32502. Persons whose substantial interests are affected by this RAP Order have a right to petition for an administrative hearing pursuant to Sections 120.569 and 120.57, F.S. to challenge the RAP Order. Any person has the right to comment or express opposition to the RAP Order. A Petition pursuant to Sections 120.569 and 120 .57, F.S. must contain the information set forth below and must be filed  (received) in the Department's Office of General Counsel, 3900 Commonwealth Boulevard, Tallahassee, Florida 32399-3000, within 45 days of receipt of this Notice. A copy of the Petition must also be mailed at the time of filing to the District Office named above at the address indicated. Failure to file a Petition within the 45 days constitutes a waiver of any right such person has to an administrative hearing.
    The Petition shall contain the following information: (a) The name, address, and telephone number of each petitioner; (b) the Department's identification number for the RAP Order and the county in which the subject matter or activity is located; (c) A statement of how and when each petitioner received notice of the RAP Order; (d) A statement of how each petitioner's substantial interests are affected by the RAP Order; (e) Either a statement of the material facts disputed by petitioner or a statement that the petitioner does not dispute any material facts; (f) A statement of facts which petitioner contends warrant reversal or modification of the RAP Order; (g) A statement of which rules or statutes petitioner contends require reversal or modification of the RAP Order; (h) A statement of the relief sought by petitioner, stating precisely the action petitioner wants the Department to take with respect to the RAP Order.
    If a Petition is filed, the administrative hearing process is designed to formulate agency action. Accordingly, the Department's final action may be different from the position taken by it in this Notice. Persons whose substantial interests will be affected by any decision of the Department with regard to the subject RAP Order have the right to petition to become a party to the proceeding. The petition must conform to the requirements specified above and be filed (received} in the Office of General Counsel at the above address of the Department within 45 days of receipt of this Notice. Failure to petition within the allowed time frame constitutes a waiver of any right such person has to request a hearing under Sections 120.569 and 120.57, F.S., and to participate as a party to this proceeding. Any subsequent intervention will only be at the approval of the presiding officer  upon motion filed pursuant to Rule 28-106.205, F.A.C.
    Any person may submit comments or request a public meeting regarding the proposed permitting decision pursuant to Section 403.722(10}, F.S. A request for a public meeting is not equivalent to a request for a formal or informal administrative hearing.
    Public meetings are not evidentiary in nature, and information submitted at a public meeting is for non-binding consideration only. A public meeting is not subject to court or appellate review. Any comment or request for a public meeting must be filed (received) in the Office of General Counsel. Agency Clerk, within 45 days of publication of this Notice, unless such period is extended by the Department. Failure to file a request for a public meeting within this time period  shall constitute a waiver of any right such a person may have to request a meeting under Section 403.722(10), F.S.

 

    Under Rule 62-110.106(4), F.A.C., a person whose substantial interests are affected by the Department's action may also request an extension of time to  submit comments, request a public meeting, or file a petition for an administrative hearing. The Department may, for good cause shown, grant the request for an extension of time.
Requests for extension of time must be filed with the Office of General Counsel of the Department at 3900 Commonwealth Boulevard, Mail Station 35, Tallahassee, Florida 32399-3000, or via electronic correspondence at This email address is being protected from spambots.
