NOTICE OF DRAFT PERMIT
The Department of Environmental Protection gives notice of its preparation of a draft permit to Emerald Coast Utilities Authority (ECUA), Donald C. Palmer, P.E., 2980 Old Chemstrand Rd, Cantonment, Florida 32533, for the ECUA - Central Water Reclamation Facility (CWRF). This permit authorizes the permittee to continue to operate and construct modifications for the existing 22.5 MGD domestic wastewater treatment facility. This permit authorizes continued discharge of 5.0 MGD of treated effluent to wetlands leading to Perdido Bay through International Paper’s (IP) Rainwater Tract wetlands (FL0002526); construction of a new backup discharge of 6.75 MGD of treated effluent to approximately 80 wetland acres leading to the Escambia River in accordance with provisions of 403.086(8)(a), F.S. (APRICOT Act) with a wasteload allocation from the North Escambia Bay Nutrient TMDL; and directs 42.35 MGD of reclaimed water to industrial reuse systems, rapid rate and slow-rate restricted public access systems. The 42.35 MGD industrial reuse and land application includes:
• Existing industrial reuse of up
to 20.00 MGD to Florida Power
and Light’s Gulf Clean Energy
Center.
• Existing industrial reuse of up
to 8.00 MGD to International
Paper Pensacola Mill.
• Existing industrial reuse of up
to 1.60 MGD for ECUA’s
CWRF onsite plant reuse.
• Land application of 10.20 MGD
of reclaimed water to eleven
proposed wetland infiltration
cells constructed in onsite
uplands under provision “other
reuse and land application
systems” Rule 62-610.100(4)
F.A.C.
• Land application of 2.52 MGD
of reclaimed water to existing
slow-rate restricted public
access onsite sprayfields.
The facility is located at latitude 30o 36' 12" N, longitude 87o 16' 3" W on 2980 Old Chemstrand Road, Cantonment, Florida 32533, in Escambia County. The Department has assigned permit file number FL0559351-025-DW1P to the proposed project.
The permit application file and supporting data are available for public inspection during normal business hours, 8:00 a.m. to 5:00 p.m., Monday through Friday, except legal holidays, at the Department's Northwest District Office, 160 W. Government Street, Suite 308, Pensacola, Florida 32502-5794, at phone number (850)595-8300. Written Comments or Request for Public Meeting
Any interested person may submit written comments on the Department's proposed permitting decision or may submit a written request for a public meeting to DEP Northwest District, 160 W. file number; and the county in
which the project is proposed;
(b) A statement of how and when
notice of the Department's
action or proposed action was
received;
(c) A statement of the facts the
Department should consider in
making the final decision;

modification of the
Department's action or
proposed action; and
(e) If desired, a request that a public
meeting be scheduled, including
a statement of the nature of the
issues proposed to be raised at
the meeting.
If a public meeting is held, any person may submit oral or written statements and data at the public meeting on the Department's proposed action. As a result of significant public comment, the Department's final action may be different from the position taken by it in this draft permit.
Time Period for Submitting Written Comments or Requesting a Public Meeting
Comments submitted by any persons other than the applicant, and other than those entitled to notice under Rule 62-620.550, F.A.C., must be received within 30 days of publication of the public notice. Failure to submit comments or request a public meeting within this time period shall constitute a waiver of any right such person may have to submit comments or request a public meeting under Rule 62-620.555, F.A.C.
If a public meeting is scheduled, the public comment period is extended until the close of the public meeting. However, the Department may not always grant a request for a public meeting. Therefore, written comments should be submitted within 30 days of publication of this notice, even if a public meeting is requested.

Residential Contract for Purchase and Sale (“Contract”), approved by the Florida Realtors and The Florida Bar. Attached hereto as Exhibit “A”.
5. The Contract concerns the following real property located in Escambia County,
Florida: 1505 North Davis Highway, Pensacola, Florida 32503,
Legal Description: S 26 FT of LT 19 ALL LT 20 BLK 97 EAST KING OR 8204 P 154 CA 65 (the “Property”).
6. The purchase price for the Property was $57,000.00.
7. Plaintiff timely delivered the required deposit of $570.00.
8. The Contract was a cash transaction with no financing contingency.
9. The closing date was on or before March 23, 2026.
10. Plaintiff provided all remaining funds due under the contract and signed all required documents on March 23, 2026.
11. Defendant did not attend the closing and has refused to sign all documents related to the closing of the Property.
12. Pursuant to Florida Rule of Civil Procedure 1.120(c), all conditions precedent have been performed, have occurred, or have been waived.
13. Defendant failed and refused to convey marketable title as required by the
Contract.
14. Plaintiff provided Defendant notice of default and opportunity to cure.
15. Defendant failed to cure.
COUNT ONE - BREACH OF
CONTRACT
16. Plaintiff restates and realleges paragraphs 1 -15 above, as if stated herein.
17. The Contract is valid and enforceable.
18. Plaintiff fully performed all obligations.
19. Defendant materially breached the Contract by refusing to convey title.
20. Plaintiff has suffered damages as a result of the breach.
21. Pursuant to the Contract, Plaintiff is entitled to recover attorney’s fees and costs.
WHEREFORE, Plaintiff demands judgment for damages, interest, attorney’s fees, costs, and all further relief deemed appropriate.
COUNT TWO - SPECIFIC
PERFORMANCE
22. Plaintiff restates and realleges paragraphs 1 - 21 above, as if stated herein.
23. The Property is unique under Florida law.
24. Monetary damages are inadequate.
25. Plaintiff has performed all conditions precedent and remains ready, willing, and
able to close.
26. Defendant refuses to perform.
27. Equity requires enforcement of the Contract.
WHEREFORE, Plaintiff requests an order compelling Defendant to convey the Property, together with attorney’s fees, costs, and equitable relief.
